The construction industry is fraught with risk for claims of property damage, personal injury, and negligence. At all phases of construction, and even post-construction, the potential for a lawsuit is always looming. Contractors liability insurance should be acquired by everyone associated with a construction project, from architects and engineers, construction managers, general contractors, and subcontractors (trade contractors).

Basic contractor liability insurance covers bodily injury and property damage. Depending on the scope of service provided by the contractor, insurance needs may vary. Many contractors tend to purchase their policies based on cost – the cheapest policy allowable. Contractors should always maintain adequate insurance to cover any unforeseen job site accident or an event leading to property damage. If the contractor is found to be negligent, then the insurance company will pay for the damages or injury. If the contractor is not negligent, the insurance company may still pay for the damages or injury, but the insurance company will investigate the cause of the incident and file a lawsuit accordingly. Either way, the contractor is covered, and the insurance provider will never file a lawsuit against its own customer.

Unfortunately, premiums have skyrocketed in the past few years. In response, more and more contractors are purchasing the least expensive basic policy allowable. To ensure the contractor does not have too many gaps in their policy, they can look at additional ways to keep their premium rates manageable, such as getting quotes from several insurance companies, talking with other contractors to compare insurance companies, having a solid risk management plan, and limiting the scope of services they provide to be sure they have adequate insurance coverage.

Anyone in the construction industry is well aware that they are at risk for potential lawsuits by clients, subcontractors, and employees. Construction professionals should be able to focus on construction, and leave the risks to insurance companies.
